PSEA Event Platform(s) "Attendee Hub" Terms of Use

Welcome to the PSEA Attendee Hub Community! By accessing or using the PSEA Attendee Hub Community, you agree to abide by the below terms (the “Terms” or the “Agreement”) as well as the Privacy Policy which may be updated by us from time to time in our sole discretion. This Agreement is between you (“You” or “Your”) and PSEA on behalf of itself and its wholly-owned subsidiaries, as applicable (“PSEA” or “We” or “Our”).
These Terms of Use were last updated on May 15, 2023.
The goal of the PSEA Attendee Hub Community is to provide an environment for PSEA members, staff, and guest users to share, connect, and do the business of the association.
Your Responsibilities:
Play nice: PSEA delegates are a diverse bunch from across the state with an array of different experiences and opinions. You are free to disagree with the people you encounter, but be respectful at all times.
Be thoughtful: Content containing false or misleading information will be removed. Things that do not seem abusive, obscene, or offensive to you might be perceived as such by others.
Stay safe: Avoid posting confidential information. Also never distribute your account username or password. Sharing logins is a violation of the terms of use and a huge security risk.
Don’t sell: Unsolicited offers, third-party services, and all other forms of unauthorized commercial activity are prohibited. It is against the Community Terms to submit content in exchange for payment or other consideration from another person or entity.
Follow the law: Do not send messages that violate anti-spam laws. Similarly, messages should not be posted if they encourage or facilitate users to arrive at any agreement that either expressly or impliedly leads to price fixing, a boycott of another's business, or other conduct that illegally restricts free trade.
Don’t infect: Do not upload files that contain viruses or similar software or programs designed to damage computer systems.
Respect other’s rights: Do not post material in violation of a third party’s intellectual property, privacy, or publicity rights.
Don’t be obscene: Do not post anything inappropriate, obscene, abusive, libelous, tortious or otherwise unlawful. This is not the place for that sort of thing.
Help us out: If something seems hostile, inaccurate, or spammy, let us know. Our moderators review every report they receive and take action when someone violates these guidelines.
Follow discussion etiquette: Have a concise and clear subject line that includes Your topic. Do not send messages to all community members with “following,” “me, too,” or “thanks for the information.”
Use of PSEA Attendee Hub
DO NOT POST ANY DEFAMATORY, ABUSIVE, PROFANE, THREATENING, HARASSING, DISCRIMINATORY, OFFENSIVE, OR ILLEGAL MATERIALS. DO NOT POST ANY INFORMATION OR OTHER MATERIAL PROTECTED BY COPYRIGHT WITHOUT THE PERMISSION OF THE COPYRIGHT OWNER. BY POSTING MATERIAL, THE POSTING PARTY WARRANTS AND REPRESENTS THAT HE OR SHE OWNS THE COPYRIGHT WITH RESPECT TO SUCH MATERIAL OR HAS RECEIVED PERMISSION FROM THE COPYRIGHT OWNER. IN ADDITION, THE POSTING PARTY GRANTS PSEA AND USERS OF THE PLATFORM THE NONEXCLUSIVE RIGHT AND LICENSE TO DISPLAY, COPY, PUBLISH, DISTRIBUTE, TRANSMIT, PRINT, AND USE SUCH INFORMATION OR OTHER MATERIAL.
PSEA RESERVES THE RIGHT TO TERMINATE ACCESS TO ANY USER WHO DOES NOT ABIDE BY THESE TERMS OF USE AND TO DELETE POSTS AT ANY TIME IN ITS SOLE DISCRETION.
Abuse Policy
PSEA reserves the right to remove material or block individuals that do not abide by the community guidelines.
Severe abuses such as harassment, discriminatory language, libel, or posts that upload malicious files will immediately be removed without warning and may be reviewed by PSEA’s legal department.
Trademarks
PSEA, PSEA Attendee Hub Community, and other PSEA trademarks are owned by PSEA (or Cvent) and may not be used without our prior written permission.
Indemnity
You agree to indemnify, defend and hold PSEA and Our subsidiaries, affiliates, officers, agents, and employees harmless from any claims, demands, liabilities, losses, damages, costs and expenses (including, without limitation, reasonable attorneys' fees) arising from: (i) Your breach of these Terms of Use or (ii) any claim made by any third party arising out of content You submit to or post on the PSEA Attendee Hub Community and Your activity on the PSEA Attendee Hub Community.

THIS PLATFORM IS PROVIDED AS A SERVICE FOR THE ATTENDEES OF PSEA EVENTS AND IS PROVIDED “AS IS”. PSEA IS NOT RESPONSIBLE FOR THE OPINIONS OR INFORMATION POSTED ON THIS PLATFORM BY OTHERS. WE DISCLAIM ALL WARRANTIES WITH REGARD TO INFORMATION POSTED ON THIS SITE, WHETHER POSTED BY PSEA OR ANY THIRD PARTY; THIS DISCLAIMER INCLUDES ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

PSEA PRIVACY POLICY

I. Introduction
The Pennsylvania State Education Association (“PSEA”) values the trust and privacy of its members and other supporters. This Privacy Policy sets forth PSEA’s practices regarding:
(1) what personal information PSEA collects about members and other persons – online via the PSEA website, digital event platforms, and offline via apps downloaded to cellphones or traditional, hard copy forms; (2) how PSEA uses that information; (3) under what circumstances PSEA may disclose that information; (4) what choices are available to PSEA members and other persons regarding collection of that information; and, (5) what security PSEA uses to protect that information. This Privacy Policy also provides some additional information for users of the PSEA website.
II. Definitions
As used in this Privacy Policy, the following terms have the meanings indicated below:
A. The term “we” or “us” means PSEA.
B. The term “you” means a current or former PSEA member or other person who provides or has provided personal information to us in connection with obtaining or using a PSEA product or service (such as a person who subscribes to a PSEA-produced electronic newsletter or accesses a PSEA website).
C. The term “personal information” means any piece of information that on its own can specifically identify a current or former PSEA member or other person who has provided personal information to us in connection with obtaining or using a PSEA product or service. This would include, but is not limited to, full name, postal address, e-mail address, social security number, telephone number, date of birth, driver’s license number or state-issued identification card number, and financial account number, credit/debit card number, or other financial information.
D. The term “PSEA website” means PSEA’s external website located at psea.org, any future websites that we may develop, and any components thereof.
E. The term “PSEA-related organizations” means any entity affiliated with or created by PSEA.
F. The term “third party” means a legal entity that is separate and independent from PSEA, its local affiliates, its national affiliate (the National Education Association or “NEA”), or any other PSEA-related organization.
G. The term “cookie” means a small file that is placed on your computer that allows a website to store, and sometimes track, information about how you use that website.
H. The term “internet forum” means an asynchronous website component that enables users to exchange ideas by posting questions, answers, and/or other content. Internet forums are also commonly referred to as “discussion groups,” “discussion boards,” “message boards,” “bulletin boards,” “blogs,” chat rooms,” and “online forums.”
III. Personal Information Collected
We may collect personal information about you from the following sources:
A. Personal Information that you voluntarily provide to us on your membership application and other PSEA forms – whether online via the PSEA website or offline via traditional, hard copy forms.
B. Personal Information that you voluntarily provide to us via the PSEA website.
C. Personal Information that we receive from our national and local affiliates or other PSEA-related organizations.
D. Personal Information that we receive from third parties.
IV. How We Use That Information
The personal information that PSEA collects about you helps us and our national and local affiliates and other PSEA-related organizations to efficiently and effectively represent you and provide you with valuable information and member benefits and services.
V. Information Sharing
In order to provide you with efficient and effective representation, information, and member benefits and services, we routinely share the personal information that we collect about you, as described in Section III above, with our national and local affiliates and PSEA-related organizations, as well as third parties that perform services on our behalf subject to PSEA policies.
Additionally, we may share any of the personal information that we collect about you, as described in Section III above, with certain third parties that share our interests or as otherwise permitted or required by law, subject to PSEA policies.
VI. Available Choices
Any personal information that you provide to us is voluntary. PSEA members may update their personal information at any time. For information on how to contact us, please visit the PSEA website at: http://www.psea.org.
If you subscribe to any PSEA-produced electronic newsletter, you may cancel your subscription at any time by following the instructions at the bottom of all such newsletters. If you have any problems canceling such a subscription, please contact us at infoprivacy@psea.org.
VII. California Privacy Rights
California residents have a right under state law to ask entities with whom they have an established business relationship to provide certain information regarding the sharing of personal information for direct marketing purposes during the past year. PSEA will honor such a request coming from any current or former PSEA member or other person who has provided personal information to us in connection with obtaining or using a PSEA product or service – whether residing in California or not. Box 1724, Harrisburg, PA 17105-1724, and we will respond within thirty days of receiving your request.
VIII. Information Security
We maintain administrative, technical, and physical safeguards designed to: (1) insure the security and confidentiality of your personal information; (2) protect against any anticipated threats or hazards to the security or integrity of such information; and (3) protect against unauthorized access to or use of such information. IX. Additional Information for Users of the PSEA Web Site
A. Collection and Use of Non-Personal Information
If you use the PSEA website, you provide us with certain non-personal information in addition to any personal information that you may voluntarily provide. For example, if you browse the PSEA website or download information, our operating system automatically records the following non-personal information:
1. The Internet domain for your Internet service (such as “xcompany.com” or “xcompany.net” if you use a private Internet access account, or “yourcollege.edu” if you connect from a college or university domain);
2. The type of browser that you use (such as “Microsoft Internet Explorer”);
3. The type of operating system that you use (such as Windows or Macintosh);
4. The date and time that you visit the PSEA website and the web pages that you view;
5. The address of the previous website that you visited if you linked to us from another website; and,
6. The address of the next website that you visit if you link to it from the PSEA website.
We use the above non-personal information to diagnose technical problems and track user interests so that we can provide content that interests you.
We gather this non-personal information in the aggregate and we share it in the same manner that we share personal information, as described in Section V above.
B. Cookies
We use cookies to track what you are viewing when you visit the PSEA website, and to enhance your user experience. In order to provide you with customized content and an enhanced user experience, certain cookies used by PSEA identify you as an individual. If you are concerned about PSEA's use of cookies, check your Internet browser. Most have a setting that will allow you to reject cookies. However, some PSEA website features and services may not function properly if your cookies are disabled.
C. Internet Forums
If you participate in an internet forum on the PSEA website, your comments, along with any personal information that you voluntarily disclose, may be collected, used, and shared by anyone with access to that forum. We are not responsible for the personal information that you choose to submit in a discussion forum.
D. Children
The PSEA website(s) are general websites, and we do not knowingly collect any personal information from children under the age of 13.
E. External Links
This Privacy Policy applies only to the PSEA website and affiliated apps. It does not apply to or cover any external or third-party websites that are linked to or from the PSEA website for which we are not responsible (“linked-sites”). These linked-sites will have their own policies and practices regarding their collection and use of personal information, non-personal information, and cookies which may be different from ours. We encourage you to familiarize yourself with the policies and practices of the linked-sites especially if you provide personal information to them.
X. Effective Date, Amendments, and Consent to This Privacy Policy
This Privacy Policy is effective May 3, 2012. We retain the right to amend or otherwise update this Privacy Policy at any time for any reason. By joining PSEA or using the PSEA website, you consent to the collection, use, and sharing of personal information as we have described herein. If we amend or update our Privacy Policy, we will post the changes online at the PSEA website so that you are always aware of PSEA’s current practices.
