Age discrimination against workers age 40 and older is prohibited by the federal Age Discrimination in Employment Act (ADEA).
Under the ADEA, it is unlawful for an employer to:
Discrimination based on disability is prohibited by the federal Americans with Disabilities Act (ADA), the federal Rehabilitation Act, and state law.
State law prohibits discrimination based on disability and is similar to the ADA.
Discrimination based on race, color, religion, sex, or national origin is prohibited by Title VII of the federal Civil Rights Act of 1964 and the Pennsylvania Human Relations Act (PHRA).
Title VII also prohibits retaliation against a person for complaining about discrimination, filing a charge of discrimination, or participating in a discrimination investigation or lawsuit. Discrimination based on pregnancy is prohibited by the Pregnancy Discrimination Act, an amendment to Title VII.
State law prohibits discrimination based on race, color, religion, ancestry, sex, and national origin, and retaliation for filing a complaint with or participating in a Pennsylvania Human Relations Commission proceeding.
Discrimination based on genetic information is prohibited by federal law passed in 2008.
Genetic information includes genetic tests for an employee or his/her family, as well as an employee’s family medical history. The law also prohibits retaliation against a person who initiated or participated in a discrimination investigation or lawsuit.
